"In Jesus' name." Interesting.

If Obama is a Christian, as he says he is there is no question. The only way to approach God, the Father is through Jesus. Jesus says so. God is not a "higher power" He is God, Creator of everything, the Holy Spirit says so. Jesus is the Son of God, God said so, The Son came to earth to seek and to save the lost. The Son of the creator of everything says so. If Obama is willing to be president of the United States without Jesus without God you will soon see that was a catastrophic error in judgment for which we will all pay dearly.

Jesus warns us to "not fear those who kill the body but cannot kill the soul. Rather fear him who can destroy both soul and body in hell." Your choice....

Letter to Sen Alexander and Sen Corker

The senate did a great job protecting the public from the Big Three but apparently has failed with the banks. If any of the corporations have used "bailout funds" for salaries, bonuses or any form of compensation you had better get the money back and if corporate jets are still flying on taxpayer provided funds you had better get the money back.
 
While having to limit their own spending the public will remember their money being used to pay millions of dollars in bonuses and corporate jets and that will be a bad memory for politicians to try to explain.
 
Congress has a problem with carrying out their responsibilities of oversight. Remember the Gulf of Tonkin Resolution in Viet Nam? Remember a similar resolution for the Iraq war? The senate defers too often to the Executive branch instead of being part of the checks and balances of power. With the Patriot Act that you supported we are closer than ever to becoming a military dictatorship. Another Republic into the dust……

I don't know if Billy Graham believed it or it was just hype but Billy Graham was not a spiritural advisor" to any politicians. Presidents used him to get to the people who followed him, today's Religious Right.

Today it is Rick Warren. Obama wants people to stop saying he is not a Christian. He hopes that associating with Rick Warren will do that.

Gay people are noisy but unnecessary to win elections. They better be quiet a Republic has a limited amount of patience with minorities... In a Democracy minorities have to get along on what the majority is willing to give them. In a Republic the majority is a bit more lenient but don't push us....

Not a good outlook for the stock market in the foreseeable future..

Remember when the stock market was for investors? People bought stock in a company, held it for months if not years and watched the price go up and down confident that in the long run the direction would be up. If a company had a bad week, month or quarter the public might not know about it until the situation was corrected and the stock price would have been unaffected. Today a corporation may be valued at $100 billion dollars one week $30 billion dollars the next and $75 billion dollars the following week. It is not logical. The value of the stock of a corporation no longer reflects the value of the corporation.  The stock market is a crap shoot. Then we find stock market insiders have been misleading the public while cashing in on inside information. The Federal government, who we thought were the watch dogs were getting richer by not watching or working with those we thought they were watching.
 
Not a good outlook for the stock market in the foreseeable future..

Christians lost the battle over Gay Rights long ago due to their acceptance of adultery, fornication, co-habitation, intolerance of birth-control measures etc. When Christians watch 'R' and 'X' movies they are endorsing the activities in the movie. If it is acceptable for Christians to observe heterosexuals engaged in all types of sexual activities real or simulated, why shouldn't homosexuals enjoy the same privileges? Heterosexuals recognize Common Law marriages and Palimony suits so why not homosexual commitments and the associated legal privileges? Gay unions of some sort are just a matter of time and Christians' tolerance for sins they understand takes them out of the debate.
 
On the subject of the Don't Ask, Don't Tell policy members of the military will make the final decision. If heterosexual members of the military are not comfortable serving with homosexuals, a major drop in enlistments and re-enlistments will decide the Obama policy.
 
Few seem to recognize Billy Graham was used by presidents to get on the side of people who followed or accepted Billy Graham, the Religious Right. Same with Rick Warren. Obama will get people to stop saying he is not a Christian because he associates with Rick Warren. Hopefully Rick will use the stage to state his/our beliefs. He will take the heat and we can say as Peter said, "We do not know him."
 
This is going to be a great four years.....I'm looking forward to them...

The nationalization of corporations needs to stop. There is nothing in the Constitution that permits the Federal Government to own private businesses even if it is a temporary situation. The Federal Government is in place too protect us from our enemies not from ourselves. NO MORE BAILOUTS...
Now to be fair and in an attempt to re-establish the peoples' trust in government I encourage you and your fellow senators and house members to renounce your bloated Federal pension and assume all costs for the health benefit program.

Zero-Tolerance Does Not Work

The climate verging on paranoia in schools has initiated countless security policies and procedures aimed at protecting their students---often from themselves.
The concept of zero tolerance, full and mandatory punishment for any transgression of the law or rules regardless of size first appeared during the 1980s as a safeguard against drug abuse and various other legal infractions including trespassing and sexual harassment. By the 1990s the mandatory punishment policy had been adopted by the nation's school systems in response to school shootings and other student-initiated acts of violence.
Zero-tolerance policies punish all offenses severely, no matter how minor. School systems began adopting these rough codes after Congress passed the 1994 Gun-Free Schools Act, which required a one-year expulsion for any child bring a firearm or bomb to school. In many states zero-tolerance rules also cover fighting, drug, or alcohol use, and gang activity, as well as relatively minor offenses such as possessing over-the-counter medication and disrespect of authority. Most schools have zero-tolerance policies for firearms or other 'weapons" as well as for drugs and alcohol.
In response to school shootings zero-tolerance policies have been tightened creating a national intolerance for childish behavior. In some systems carrying cough drops, wearing black lipstick, dying your hair blue are expellable offenses. By definition, zero-tolerance erases distinctions among student offense, hence the national crackdown on Alka-Seltzer. At least twenty children in four states have been suspended from school for possession of the fizzy tablets in violation of zero-tolerance drug policies.
Zero-tolerance policies encroach on the constitutional rights of students. Advocates cite violence in schools as justification. Critics say the one-strike-and-you're-out policies go too far. Research indicates that, as implemented, zero-tolerance policies are ineffective in the long run and are related to a number of negative consequences, including increased rates of school drop out.
The imposition of draconian and inflexible zero-tolerance policies teaches Americans that government authorities have total power and can violate constitutional rights as they see fit. Also, it communicates to young people the idea their rights may be highly---and often unjustly---restricted on school policy.
Zero-tolerance policies punish otherwise innocent children who make a single mistake.
On a school bus in rural Mississippi five high school students passed the time on their long ride home by tossing peanuts at each other. When one of the nuts hit the bus driver, she pulled the bus over, called police, and had the boys arrested for assault, punishable by five years in prison. The criminal charges were dropped but the boys lost bus privileges. Unable to make the thirty-mile trip, all five dropped out of school.
In Maryland, a twelve-year-old student was charged with violating the school's zero-tolerance policy on "drug use and trafficking" and suspended from taking part in school activities. Her crime? She had attempted to help a friend who was suffering an asthma attack by offering her an inhaler. The friend's mother says her daughter would have died with the student's help.
In Columbus, Ohio a second-grader was suspended for drawing a paper gun, cutting it our, and pointing it at classmates.
A twelve-year-old-boy was handcuffed and jailed after he stomped in a puddle, splashing classmates.
Jewish youth in several schools were suspended for wearing the Star of David, which was sometimes used as a symbol of gang membership.
Zero-tolerance policies are ineffective tools for discouraging school violence which has remained fairly level since the early 1990s. 35 to 45 percent of suspensions are for repeat offenders. So we end up punishing honor students to send a message to the bad kids. But the data show the bad kids are not getting the message. Numerous statistics indicate the zero-tolerance security measures fail to decrease the number of students bringing weapons to schools, victims of violent crime, and students trying alcohol, cigarettes, and other illegal drugs.
Under zero-tolerance polices the elementary student is punished in the same way the high school senior is punished. The one who breaks the rules accidentally is punished the same as the student who wants to harm others. Zero-tolerance policies do not educate and reform America's youth but instead teach them that they possess no true rights.
If we like zero-tolerance policies how about zero-tolerance for DUI, for driving while texting, for injuring or killing a construction worker in a construction zone, for injuring or killing a police officer during an emergency stop, sex crimes, any crime destroying the feeling of security of the victim, and...... We are willing to live with zero-tolerance for our children but not for ourselves.
Surveillance cameras also fail their intended purpose....

Big Three and Banks

We need a bailout exit strategy. The UAW is complaining but  It is time for the members of the UAW to face reality. They have been living in fantasy land for 40 years. No company can give benefits like the "Big Three" negotiated for long. The Job Bank, almost free prescriptions, a bloated hourly rate for high school graduates and high school dropouts. To be competitive wages have to be comparable with other non UAW workers. Otherwise GM, Ford, Chrysler will not exist in 5 years.
 
 
Also as far as continuing to bailout banks see what Thomas Jefferson said in 1802:
 
'I believe that banking institutions are more dangerous to our liberties than standing armies. If the American people ever allow private banks to control the issue of their currency, first by inflation, then by deflation, the banks and corporations that will grow up around the banks will deprive the people of all property until their children wake-up homeless on the continent their fathers conquered..'

At one time Americans believed they had rights no government could violate. They believed they had the authority to resist government encroachment of their rights. That government exists at the behest of its citizens and  that government is there to protect, defend, and even enhance their freedoms, not violate them. 
 
A standing army is an army composed of full time professional soldiers who "stand over", in other words, do not disband during times of peace. They differ from army reserves that are activated only during such times as war or natural disasters.
 
In the British Colonies there was a sentiment of distrust of peacetime armies; too much power for the head of state, versus civilian control of the military. This led to the British Bill of Rights which reserves authority over a standing army to the Parliament, not the King.
 
While none of the Founding Documents mention the word "police", our Municipal, City, County, and State Police fit this description of a Standing Army.
 
A Standing Army (or police) with Standing Orders define a Police State, Marshall Law, or military rule.
 
A Standing Order is a "general order" to be obeyed if some condition comes into existence in the future. A standing order is made at some time prior to the event and is non-specific as to the name of the accused.
 
Police officers today generally have (or "think" they have!) orders to detain, search, and/or arrest those "they feel" violated a law. The Founding Fathers were very much opposed to this kind of discretionary power being placed in the hands of any one person (and is evident by the general design of the Federal Government: the distribution of power across 3 branches, the system of "checks and balances", etc).
 
The Founders intended for there to be a civilian defense force, and for it to be reactive to the needs of the people, for they knew that an autonomous (self-directed) police force or standing army is ultimately unaccountable to the People, and uncontrollable by the People, and thus a thing to be feared. They knew, because they were occupied by the English Army. Today, conditions are similar. While it isn't a foreign army that occupies us, the abuses against the people are the same.
 
There are 2 elements of the Fourth Amendment that were intended to prevent Standing Orders from being executed against the people:
 
1.       The first is the "oath or affirmation": a sworn civilian complaint and
2.       The second is that warrants must be specific.
 
Both are intended to remove the discretion of arrest/search/seizure from the arresting officer, and provides the needed "checks and balances".

If the complaint MUST ALWAYS come from a civilian (i.e., not the government; not the arresting authority) this eliminates the invocation of "general" or standing orders (and a big conflict of interest!), and ensures that the Police Force is "reactive", and not self-directed. If all arrests/searches/seizures are documented with the specific justifications of the action (the warrant), this also removes the arbitrary discretion from the officer.
 
The Fourth Amendment requires specific Warrants and that the complaint be initiated by a civilian thus prohibiting the police from executing "Standing Orders" against the people. Today, in modern America, when the police arrest someone, there is rarely a specific warrant, and rarely is there the "oath or affirmation" of a complaining civilian. The lawyers, political pundits, corporate-owned "free press", and even college textbooks will argue why this is "necessarily so", but the simple fact remains:
 
·          Most Police actions in America lack a injured victim (except for perhaps the accused!), thus,
·          Most Police actions in America lack Probable Cause, thus
·          Most Police actions in America lack a valid Warrant, thus
·          Most Police actions in America are Unconstitutional.
 
Many Americans have come to blindly believe that the government will ensure our safety (or at least provide the illusion of safety). But such gullibility comes at a steep price---the devaluation of our freedoms. Requiring government to operate under the Constitution is the only protection the people have.
 
Benjamin Franklin said "Any society that would give up a little liberty to gain a little security will deserve neither and lose both."

If he would have appointed who the system wanted appointed to replace Obama as a Senator from Illinois he would have gotten everything he wanted, more money, better job for his wife, higher speaking-fees etc. The mentor would have told him not to say anything, things just happen, favors get repaid and everyone maintains plausible deniability.
 
Don't think so? Look at the employment history of Obama and his wife and see how Mrs Obama was given better jobs just because she was married to the "Community Organizer." See how he progressed and all with plausible deniability.
 
Obamas are not the only ones they are just part of the system where favors get repaid people get rich all with plausible deniability.
 
Bill Clinton, ex-President worth hundreds of millions of dollars. Mrs Bill Clinton worth millions of dollars just because, when there is room, she sleeps Bill's bed. Senators and Representatives, members of the President's cabinet, ex-presidential advisers all multi-millionaires and don't forget Bush avoiding serving in the Guard. All with plausible deniability.
 
Governor Blagojevich could have had it all if he would have maintained silence. As Forrest says, "Stupid is, as stupid does."

The Problem With the OJ Simpson Guilty Verdict is.....

The problem with the OJ Simpson guilty verdict is the judicial system it exposes. One problem that should be worrisome to us all is that prior findings of "not guilty" or "innocent" are held against you. The Fifth Amendment of our Constitution reads, "nor shall any person be subject for he same offence to be twice put in jeopardy of life or limb." The Sixth Amendment reads: "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trail, by an impartial jury of the state and district wherein the crime shall have been committed…" If it can happen to OJ it can happen to you.
 
The mistake OJ made was to think he was beyond the reach of the judicial system. As the Innocence Project has proved and continues to prove, if the judicial system wants you it will get you, guilt and innocence are not relevant.

Reasons our Senators and Representatives have to go to the office every day.
 
To begin with a bloody war with no plan for winning or for leaving and the biggest deficit in the history of the country. We've lost the manufacturing edge while our once-great companies are getting slaughtered by health care costs and having to pay people not to work. Gas prices skyrocketed and will never return to reasonable and nobody in power has a coherent energy policy. Our schools are in trouble. Our children are being raised in a culture where they have no privacy and their Bill of Rights privileges have been taken away by an unconstitutional "Patriot Act." Our borders are sieves. The middle class is being squeezed every which way.
 
Homeland security is taking our shoes off in airports and throwing away our shampoo. Surveillance cameras may show us who was in an area but do nothing to stop crime.
 
Need I continue?

Big Three Bailout

The CEO of Ford says he is willing to work for $1 a year. Until all funds Ford receives from the government are repaid in full with interest neither he nor any officer of Ford should receive a dime in salary or bonus or any form of compensation. None. All senior management should cancel any parachutes they have golden or otherwise. No parachutes.
 
The same goes for any corporation receiving welfare.
 
When the subject of cutting or eliminating jobs is brought up no one can be paid who does not work. This bank of experienced workers cannot exist if the taxpayers have to help keep them in business. No one receives any compensation who does not work in the commonly accepted use of the term work.
 
Let them fail…

Sec Clinton  will do what Sec Rice is doing. Travel the world, making friends for when they are no longer Secretary of State. Remain on the back burner until something happens and they take the blame for failing to stop whatever they were supposed to have stopped. The important part is their new friends will ensure they are multi-millionaires when out of office. You gotta love our country.

Unalienable Rights? Yes or No!

The right to choose any view on abortion is considered a more sacred right than the right of life to the child. Rights have a more valid place in deciding morality than doing or believing what is right.
 
Partial-birth abortions highlighted the lack of morality a few years ago. Although the majority of Americans opposed partial-birth abortions, and both houses of Congress passed legislation against it , the president refused to sign the legislation because it would take away the mother's right to choose.  Freedom to choose was the deciding factor, ignoring long-held foundations concerning the right to life. No matter how gory, how unjustified, how unnecessary, how contradictory, how cruel or how sinful partial-birth abortion is, choosing is a more precious right than the infant's life. Morality has been replaced with freedom.
 
Our Declaration of Independence reads: "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."
 
As the argument was concerning slaves and Native Americans the unborn are not human beings and do not deserve the rights we claim as unalienable rights. If we can limit these rights for others we limit these rights for ourselves.

Techniques Do Not Work

The government of India is most likely torturing the Mumbai killer they captured. I for one do not care. Most of the techniques being used are not working. The surveillance cameras got the killers' pictures but did not prohibit them from carrying out their terrorist attack. I like the technique where you take two terrorists up in a helicopter. Throw one out and ask the other questions.
 
The closer Obama gets to being the President the farther away he will get from his campaign comments. Interesting how reality affects our view of things.

Bear Hunting within city limits?

Our local paper, The Mountain Press has an article this morning concerning "Record Bear Hunt Expected." TWRA expects 400 bears "to be taken" this year. That sounds better than killed, injured, and or maimed, doesn't it?
 
The purpose of this letter is to encourage you to do something, anything, to prohibit hunting within the city limits of Gatlinburg or any city. When hunting season comes there is a lot of discussion about the pros and cons of hunting within the city limits and we are told State law permits it. That being the case I write this note to you.
 
My wife and I moved to Gatlinburg in 1998 when I retired. It has always intrigued me that hunting is permitted by state law within the city limits of Gatlinburg. Is Tennessee still living in the 19th century or what?
 
My wife and I moved from Ohio where we lived most of our lives. Over the years it was obvious dangerous situations were permitted to exist. In a neighboring county there was a railway crossing without signals. Every year or two there was an accident and local citizens were killed. Local residents asked state officials, your Ohio counterpart, to have warning signals installed with no affect. But then one day a truck carrying state employees was struck by a train and everyone in the truck was killed. Within a few months crossing signals were installed. In a second neighboring county there were the usual drunk driving accidents with no government response. Then one day the daughter of a local congressman was killed by a drunk driver. That county then passed the strictest DUI laws in the state. To make a long story short it appeared a state employee or family member had to be sacrificed before the state would react.
 
I am wondering if that is the way things are done in Tennessee as well. To allow hunting inside of a city especially one as densely populated as Gatlinburg is a disaster waiting to happen. I realize the killing or wounding of a local resident will not count so when a tourist is killed or better yet seriously wounded and the national media takes hold of the story what will you and your administration say? You did not know? Can you imagine if a tourist is shot and has to be put on life support and the family and a local hospital get into an argument concerning removing the life support, the damage to Gatlinburg's reputation as well as the state?
 
I realize the most important job an elected official has is to ensure their re-election thus requiring them to avoid sensitive issues such as hunting within city limits and their second most important job is to not upset those who give them money, such as hunters but someone has to demonstrate some common sense and concern for public safety.
 
Last Monday in Chalet Village, in Gatlinburg, there was a bear killed on a lady's property under her deck, right in front of her.  How do you think bear hunting in Nashville would be accepted? We know that will not happen because the people who make the laws would not allow it, they live there.
 
Bear hunting with dogs, high-tech weapons and equipment, cell phones and radio-collars on the dogs are a major PR disaster in the making.  When we see the mistakes police trained in the use of their weapons, make how can we expect more competence from the good ol' boy who just likes to kill various animals. I hope you and your administration will do the right thing.
